Terms and Conditions

Introduction

This agreement covers all subscribers to Bontech programs and services, including its websites owned and operated by Bontech. By using these programs or services, you agree to the terms of this agreement and any updates or changes that may be published. Please read this agreement before subscribing to any of our programs and services. Subscription indicates acceptance of the terms and conditions stated herein. If you do not agree with any of the terms and conditions in this agreement or any updated versions thereof, you should not use any of our programs or services. This agreement between you and Bontech is strictly limited to the terms and conditions mentioned in this agreement.

General Terms and Definitions

Bontech is a company established and operating within the Kingdom of Saudi Arabia in accordance with its laws. It offers cloud-based restaurant management systems to its clients both within and outside the Kingdom, including but not limited to the following systems: • Point of Sale (POS) System • Restaurant Management System • Support Ticket System • Table Management System • Menu Management System • Loyalty Points System • Order Display and Tracking System • Inventory Management System • Discount Coupons System The "subscriber" or "client" refers to the individual or entity entitled to use the service according to the terms and conditions set forth herein or in any specific contracts or agreements – if any – whether the individual is a person, commercial entity, governmental body, or non-profit organization. The "user" is the individual authorized to access the service based on the subscription and is the account holder who can use the service.

Agreement Duration

The agreement begins upon payment of the agreed fees for the service and acknowledgment of the content of this agreement. It remains valid as long as the subscriber continues to pay the agreed subscription fees or those mentioned in their account details. If there is a breach of any terms in this agreement, the service provider has the right to cancel the subscription and delete the subscriber’s data.

Payment and Renewal

Payment for the service is made in advance, whether for a recurring subscription service or otherwise. Renewal of the subscription must be paid before the end of the current subscription period, and the company reserves the right to collect due amounts through channels and methods it deems appropriate, whether manual collection or electronic payments.

Security Precautions

The subscriber must take security precautions to prevent unauthorized access to the service, including not sharing login links, usernames, and passwords with anyone. The service provider does not guarantee protection against damage resulting from the subscriber's failure to take the necessary precautions to secure their login information.

Technical Support

During the subscription period, the service provider will offer technical support to the subscriber through channels deemed appropriate by the provider, such as chat systems, email, phone, or field visits if requested by the subscriber and paid for.

Modifications

The service provider reserves the right to modify or replace any part of this agreement as it deems appropriate. The subscriber is responsible for periodically reviewing updates to this agreement, as the provider will publish these changes on the Terms and Conditions page in the subscriber’s account or the provider’s website or service. The continued use of the service by the subscriber constitutes implicit agreement to the modifications. The service provider may also add additional features to the website or service in the future, such as new functions, tools, content, or reports. All such features are subject to the terms and conditions of this agreement.

Termination

If the subscriber wishes to stop using the service, they may do so by simply not paying the subscription or by informing the service provider directly through the approved communication channels, including the chat system. In such cases, the subscriber’s account will be deactivated, and their data will be deleted. The service provider also reserves the right to notify the subscriber of service termination, giving them a maximum of one month to copy their data without providing reasons. All provisions of the contract that naturally survive termination will remain in effect, including but not limited to indemnities, warranties, and disclaimers.

Privacy

Regarding the service, the service provider is committed to respecting the privacy of the subscriber and all data entered during the use of the service. The provider will not access, view, or copy the data entered by the subscriber unless requested by the subscriber for the purpose of facilitating their work, training, or providing service. The service provider retains the necessary data for the service subscription, which the subscriber enters during the registration process, such as the subscriber's name, email, contact information, payment details, and other data. The provider may share this data with relevant parties, including employees, contractors, or affiliated organizations, who need the data to process it on behalf of the service provider or to provide the requested service to the subscriber. Some employees, contractors, or affiliated organizations may be located outside the subscriber's or visitor's country, and using the service implies acceptance of the transfer of such data abroad. The service provider will not rent or sell any of the visitors’ or subscribers’ data to any party except as stated above or in compliance with a court order or official government directive. The service provider reserves the right to send periodic emails to the subscriber to inform them of new features, important information regarding the service or website, or the provider, or to request their feedback on the service. The provider also reserves the right to publish some of the responses or inquiries received regarding the service or website (such as technical support requests) to assist other subscribers after removing any information that could identify the subscriber.

Training

If training services are requested, sessions will be scheduled at the discretion of the service provider in coordination with the subscriber. The subscriber agrees that if they are unable to attend the training session at the agreed time, they must notify the service provider to reschedule at least 24 hours before the agreed time. Failure to do so will result in the session being counted as one of the utilized training sessions. Field visits for training may not be available at the client’s premises or subscriber's area, and the service provider is not obligated to provide training in geographic locations outside its coverage area.

Applicable Laws

Disputes or claims of violation of this agreement will be resolved according to the laws in force in the Kingdom of Saudi Arabia.
